Three defendants in a high-profile criminal case have expressed outrage, accusing federal prosecutors of violating attorney-client privilege by improperly accessing confidential legal communications. Alon Alexander, with brothers Oren and Tal Alexander, filed a motion on June 16th, 2025, in the Southern District of New York seeking an evidentiary hearing to investigate the alleged intrusion.
Central to this dispute is a digital folder titled "The Case," stored in Alon Alexander's Apple iCloud. The Alexanders, working with their attorneys, compiled sensitive legal strategies and evidence for defense against civil lawsuits alleging sexual assault and anticipated federal litigation. The defendants emphasize these materials were explicitly prepared for confidential attorney-client communications.
The government's seizure of these iCloud records in August 2024 included privileged documents, raising serious prosecutorial concerns. According to the defense, prosecutors actively reviewed confidential communications, including detailed legal strategies and evidentiary analyses. Attorney Howard Srebnick argues this intrusion violated the defendants' Fifth and Sixth Amendment rights, undermining their right to effective counsel and due process.
Prosecutors reportedly reviewed files beyond "The Case" folder, including additional attorney-client communications and strategy sessions, clearly marked as privileged.
The defense seeks an evidentiary hearing to expose the government's intrusion and requests sanctions to eliminate prosecutorial advantage. They demand disclosure of related grand jury materials to precisely determine prejudice from the prosecutors' actions.
The motion explicitly states, "The privileged material seized by the government and used here was principally in a folder in one of the defendant’s iCloud accounts titled 'The Case.'" The defense argues this violation compromised the integrity of the criminal case, necessitating immediate judicial intervention.
The hearing could significantly impact this contentious and high-stakes prosecution, highlighting concerns about prosecutorial fairness and constitutional protections.
